What Information this Privacy Policy Covers

We collect “Non-Personal Information” (i.e., information that cannot be used to identify you) and “Personally Identifiable Information” (i.e., information that can be used to identify you). Non-Personal Information includes information such as the web pages that you have viewed. Personally Identifiable Information can include information such as your name, home address, home telephone number,home email address, company information and credit card information. You are responsible for ensuring the accuracy of the Personally Identifiable Information you submit to PunchTab. Inaccurate information may affect your ability to use the Website or Services, the information you receive when using the Website or Services, and our ability to contact you. For example, your email address should be kept current because that is one of the primary manners in which we communicate with you.

What You Consent to by Using Our Website or Services

Please understand that by directly or indirectly submitting any Personally Identifiable Information to us, you consent and agree that we may collect, use and disclose such Personally Identifiable Information in accordance with this Privacy Policy and our Terms of Use, and as otherwise permitted or required by law. If you do not agree with these terms, then please do not provide any Personally Identifiable Information to us. What Information We Collect

We gather two types of information about users through the Website and our Services:

1. Non-Personal Information. When users come to our Website or use our Services, we may track, collect and aggregate Non-Personal Information indicating, among other things, which pages of our Website were visited, visits to WebPages that have registered with and/or for the Services, the order in which they were visited, when they were visited, and which hyperlinks were “clicked.” We also collect information from the URLs from which you linked to our Website or Service. Collecting such information may involve logging the IP address, operating system and browser software used by each user of the Website or Service. We also use or may use cookies to help us determine and identify repeat visitors, the type of content and sites to which a user of our Website or Service links, the length of time each user spends at any particular area of our Website or Service, which links a user selects (e.g. a Facebook “Like” or Twitter), and the specific functionalities that users choose to use. Essentially, cookies are a user’s identification card for the PunchTab servers. Cookies allow PunchTab to serve you better and more efficiently, and to personalize your experience with our Services and on our Website. Cookies are not used to retain Personally Identifiable Information. You should be able to control how and whether cookies will be accepted by your web browser. Most browsers offer instructions on how to reset the browser to reject cookies in the "Help" section of the toolbar. If you reject our cookies, certain of the functions and conveniences of this Website or Service may not work properly. We also employ a software technology called clear gifs (a.k.a. Web Beacons), that help us better manage content on our site by informing us what content is effective. Clear gifs are tiny graphics with a unique identifier, similar in function to cookies, and are used to track the online movements of Web users. In contrast to cookies, which are stored on a user’s computer hard drive, clear gifs are embedded invisibly on Web pages and are about the size of the period at the end of this sentence. We do not tie the information gathered by clear gifs to our customers’ personally identifiable information. The use of tracking technologies by our service providers, technology partners or other 3rd party assets (such as social media plug-ins) on the site is not covered by our privacy policy. These 3rd parties may use cookies, clear gifs, images, and scripts to help them better manage their content on our site. We do not have access or control over these technologies.

2. Personally Identifiable Information. PunchTab may offer you the ability to receive support, product updates and other services through a password protected support site or user account. In order to receive these services, you may be required to provide us with Personally Identifiable Information such as your name, email address and zip code. We also collect Personally Identifiable Information that you provide to us when you sign-up for the Service, participate in our public forums or our blogs, send us email messages, participate in contests/sweepstakes and/or purchase products or services on our Website. Among other things, we may use the Personally Identifiable Information that you provide to respond to your questions, provide you the specific products and services you select, send you the products that you order, send you updates about PunchTab or PunchTab events, send you email messages about Website or Service maintenance and updates and inform you of significant changes to this Privacy Policy.

a. Updates. PunchTab may offer you the ability to receive email updates either via email or another subscription service such as Facebook or Twitter. In order to subscribe to these services, you may be required to provide us with Personally Identifiable Information such as your name, email address and zip code. Out of respect for your privacy, you may choose to stop receiving marketing or promotional emails by following the unsubscribe instructions included in these emails, accessing the email preferences in your account settings page or you can contact us at support@punchtab.com.

b. Blog/Forums. PunchTab offers a blog on the Website and may offer other public forums from time to time (the “Forums”) where you can share comments and thoughts. In order to participate in the Forums, you may be required to register with us and/or provide us with Personally Identifiable Information such as your name and email address. You should be aware that any information you provide in these areas may be read, collected, and used by others who access them. To request removal of your personal information from our blog or community forum, contact us at support@punchtab.com. In some cases, we may not be able to remove your personal information, in which case we will let you know if we are unable to do so and why.

c. Purchases. When purchasing products or services through our Website, you are required to provide us with Personally Identifiable Information, such as your name, address, billing information (i.e., credit card information and billing address) (“Billing Information”), shipping address andemail address.

d. Participation in Contests, Sweepstakes, and Other Promotions. From time to time, PunchTab may offer you the opportunity to participate in a contest, sweepstakes, or other promotions on or through the Website or Service. Participation in these surveys or contests is completely voluntary and you therefore have a choice whether or not to disclose this information. If you desire to participate in any such contest, sweepstakes, or other promotion, you will be asked to provide us with certain information necessary to conduct such contest, sweepstakes, or other promotion. This information may include, among other things, your name, age, mailing address, email address, and phone number. We will not share the personally identifiable information you provide through a contest or survey with other third parties unless we give you prior notice and choice.

e. Communications with PunchTab. We may receive Personally Identifiable Information when you send us an email message or otherwise contact us.

f. Social Media Interaction. We may receive Personally Identifiable Information when you engage with our Website or Service on or through third-party social networking sites, such as Facebook or Foursquare, which will authenticate your identity and allow us to have access to information from your profile (e.g., name, e-mail address, photo, gender, birthday, location, friends, followers, the posts or the ‘likes’ you make). You can control what data you share through privacy settings available on some social networking sites. g. If you choose to use our referral service to tell a friend about our site or Services, we will ask you for your friend’s name and email address. We will automatically send your friend a one-time email inviting him or her to visit the site. Punchtab stores this information for the sole purpose of sending this one-time email and tracking the success of our referral program. Your friend may contact us at support@punchtab.com to request that we remove this information from our database.

h. Information Collected Through the PunchTab Rewards Program. We may collect Personally Identifiable Information on behalf of our customers about your activities on websites that have registered with the PunchTab Rewards Program, including, for example, if you have visited a participating website or if you have clicked a Facebook or Twitter link on the participating webpage. These tracked activities may vary between participating websites, since website owners may reward different activities on their websites for PunchTab points.

We have no ownership of this information or any direct relationship with individuals whose personally identifiable information may be processed as part of providing our Service. An individual who seeks access, who seeks to correct, amend, delete inaccurate data or withdraw consent to further contact should direct his/her query to the PunchTab customer they interact with directly (the data controller). If a PunchTab customer requests that we remove personally identifiable information on their behalf, we will respond to their request within 30 days.

PunchTab will retain personal data we process on behalf of our customers for as long as needed to provide services and as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

How We Use the Information

Please take some time to familiarize yourself with the different ways PunchTab uses the information that we gather.

1. Non-Personal Information. We use Non-Personal Information in aggregate form to build higher quality, more useful services by performing statistical analyses of the collective characteristics and behavior of our users, and by measuring demographics and interests regarding specific areas of our Website or Service.

2. Personally Identifiable Information. This Privacy Policy serves as notice that we collect Personally Identifiable Information in the manners described herein. Except as set forth in this Privacy Policy or as specifically agreed to by you, PunchTab will not disclose any Personally Identifiable Information we gather from you on the Website or Service. In addition to the other uses set forth in this Privacy Policy, we may disclose and otherwise use Personally Identifiable Information as described below.

a. Updates. We use Personally Identifiable Information collected when you sign-up for our various email or update services to send you the messages that you request us to send. We may also archive this information and/or use it for future communications with you.

b. Forums. We use Personally Identifiable Information collected during your use of the Forums to facilitate your use of the Forums. In addition we may publish this information either on the Website and/or in other publications. We may also archive this information and/or use it for future communications with you and/or your designee(s).

We use Personally Identifiable Information collected during the purchasing process to fulfill the order and provide the applicable service or product (either directly or through our providers). f. Disclosure for the PunchTab Rewards Program. In connection with the Services, PunchTab may store your Personally Identifiable Information for its internal business purposes, and may disclose or share your Personally Identifiable Information in connection with the Services and the PunchTab Rewards Program with website owners or administrators that register with PunchTab and host the PunchTab Rewards Program on their website, and any social networks that you connect to your PunchTab profile. You agree that PunchTab may disclose and/or display some Personally Identifiable Information, e.g. name and online activity and recent point accrual, on PunchTab leaderboards and through social networking sites that you connect to the PunchTab Rewards Program.

g. Disclosure to PunchTab Operations and Maintenance Contractors. Our operations and maintenance contractors may have limited access to your Personally Identifiable Information in the course of providing products or services to us. These contractors may include vendors and suppliers that provide us with technology, services, and/or content related to the operation and maintenance of the Website or Service. Access to your Personally Identifiable Information by these contractors is limited to the information reasonably necessary for the contractor to perform its limited function for us.

h. Government Authorities, Legal Rights and Actions. Social Media Widgets

Our Web site includes Social Media Features, such as the Facebook Like button and Widgets, such as the Share this button or interactive mini-programs that run on our site. These Features may collect your IP address, which page you are visiting on our site, and may set a cookie to enable the Feature to function properly. Social Media Features and Widgets are either hosted by a third party or hosted directly on our Site. Your interactions with these Features are governed by the privacy policy of the company providing it.

Confidentiality & Security of Personally Identifiable Information

The security of personal information is important to us. We will use commercially reasonable efforts to keep your Personally Identifiable Information private and will not share it with third parties, except as otherwise provided in this Privacy Policy. Updating or Deleting Your Personally Identifiable Information

We maintain a procedure in order to help you confirm that your Personally Identifiable Information remains correct and up-to-date or choose whether or not you wish to receive material from us or some of our partners.

You may also email us at support@punchtab.com or contact us using the information below in order to delete or update your Personally Identifiable Information on our systems. We try to answer every email promptly, but may not always be able to do so. We will respond to your request to access within 30 days. Keep in mind, however, that there will be residual information that will remain within our databases, access logs and other records, which may or may not contain your Personally Identifiable Information.
